The following terms and conditions govern your access to and use of the sehji website and search tool (our “Platform”). Please read these terms and conditions carefully before accessing or using our Platform.

本條款及條件適用於 閣下到訪及使用「寫字」網站及搜索工具（「本平台」），請在進入本平台前細閱有關條款及條件。

 

By using our Platform, you agree to be bound by these terms and conditions, as they may be modified or supplemented from time to time (these “Terms”). If you are accessing or using our Platform as a representative of an organisation, you are agreeing to these Terms on their behalf.

閣下使用本平台即表示同意受本條款及條件（「本條款」）約束，我們可能不時修訂或補充本條款。如 閣下作為機構代表到訪或使用本平台，即代表該機構同意本條款。

 

  1. Interpretation

釋義

 

In these Terms:

本條款中：

 

“We” or “sehji” means sehji Limited, a company incorporated in Hong Kong with business registration number 71962712 and registered office at Room 1628, 16/F, One Island South, 2 Heung Yip Road, Wong Chuk Hang, Hong Kong;

「我們」或「寫字」指寫字有限公司。寫字是一間在香港註冊成立的有限公司，商業登記號碼為71962712，註冊地址為香港黃竹坑香葉道2號One Island South 16樓28室。

“You” or the “User” means registered users of our Platform;

「閣下」或「用戶」指本平台的註冊用戶。

“Funders” means organisations or government departments or entities who provide funding;

「資助者」指提供資助的機構、政府部門或實體。

“Projects” means social innovation projects or art/cultural projects to whom funding has been given;

「項目」指獲資助的社會創新項目或藝術／文化項目。

“Project Owners” means the organisations, entities, individuals or groups who own or operate the Projects;

「項目擁有人」指擁有或營運項目的機構、實體、團體或個人。

  1. Our Platform

本平台

 

2.1    Our Platform is an integrated search tool for Projects funded in Hong Kong. As at the last updated date of these Terms, our database covers results of the following fundings:

本平台是一個綜合本港資助項目的搜索工具。截至本條款的最近更新日期，我們的資料庫涵蓋以下資助結果：

 

  1. Social Innovation and Entrepreneurship Development Fund (“SIE”)
  2. Enhancing Self-Reliance Through District Partnership Programme (“ESR”)
  3. Enhancing Employment of People with Disabilities through Small Enterprise Project (“EEE”)
  4. Community Investment and Inclusion Fund (“CIIF”)
  5. Partnership Fund for the Disadvantaged (“PFD”)
  6. Arts Development Council Grants (“ADC”)
  7. CreateSmart Initiative (“CSI”) and
  8. Arts Capacity Development Funding Scheme (“ACDFS”)

2.2    Our Platform supports text search function, meaning that by inputting term(s) into the search bar, our database will return any Projects which contains such term(s) in its project title, project summary or description, grantee name and/or partnering organisation name, across various funding sources. Our Platform is bilingual and accepts search terms in English text and Traditional Chinese characters.

本平台支援文本搜索功能，在搜尋欄中輸入相關字詞，我們的資料庫將顯示不同資助來源中，任何於項目名稱、項目摘要或簡介、申請人或機構名稱、及／或合作機構名稱包含該字詞的項目。本平台以雙語操作，接受英語及繁體中文字輸入的搜索關鍵字。

 

2.3    All funding results on our Platform, including project title, grantee name, funding amount, funding period, project summary or description (if any) of each Project, are as published by the relevant Funders on their respective websites. For each Project, we have included a direct link to the funding result published by the Funder for User’s ease of reference.

本平台上所有資助結果，包括每個項目的項目名稱、申請人或機構名稱、資助金額、資助期、項目摘要或簡介（如有），均由相關資助者在其網站上發布。我們於每個項目附上由資助者發布的資助結果之連結，以便用戶參考。

 

2.4    Funding results published by different Funders often come in different formats and they may not contain certain information/attributes that are available in other types of funding. To facilitate a meaningful search into our database and support sorting of search results, we have constructed an attribute to all Projects known as “Relevant Date”, which is determined as follows:

不同資助者發布的資助結果通常採用不同格式，它們可能不包含其他資助類型所提供的某資料或性質。為方便用戶進行有意義的搜索及支援搜尋結果的排序，我們就每個項目建立「相關日期」，該日期取決於：

 

(a)    project start date, if such information has been published; or

(b)    project approved date, if such information has been published; or

(c)    deadline for application of the relevant batch of applications.

項目獲批准日期（如有公布）；或

該屆項目的截止申請日期。

 

Please note that the “Relevant Date” is for reference only and it does not mean or imply that the Project necessarily starts on the date shown.

請注意「相關日期」僅供參考，並不代表或暗示該項目必定在所示日期開始。

 

2.5    Our database is maintained by us on a best-effort basis. We cannot guarantee that all information is accurate and complete and always up-to-date. Occasionally there may be information that contains typographical or other errors, inaccuracies or omissions. We reserve the right to correct, modify and update information anytime.

我們將盡力維持資料庫的運作，但我們無法保證所有資料均準確、完整及最新，偶爾可能出現資料排印錯誤、不準確或遺漏。我們保留隨時更正、修訂及更新資料的權利。

 

2.6    If you are the Project Owner of a Project and you are aware that certain information in the search result concerning your Project is incorrect or out-of-date, please feel free to reach out to us by email at info@sehji.co so that we may modify and update our entry.

如 閣下是項目擁有人，並發現搜尋結果中相關項目的資料有錯誤或過時，請透過電郵 info@sehji.co聯絡我們，以便我們修訂及更新相關資料。

 

2.7    The funding results displayed on our Platform are not exhaustive. Our database is continuously growing and expanding. For each funding, we start with the most recent results, and gradually cover earlier years. We will also expand the types of public funding covered by our database.

本平台顯示的資助結果並非詳盡無遺。我們持續地增加及擴展資料庫，就每項資助而言，我們從最近期的結果開始，逐漸涵蓋較早年的結果。我們亦將擴大資料庫所涵蓋的公共資助的類型。

 

2.8    sehji is an independent funding application and research institute. We are not an agent of, nor related to, any public or private Funder. Information or search results derived from our Platform is for general information only and should not be relied upon or used as the basis for making funding decisions.

寫字是一間獨立資助申請及研究機構。我們非任何公共或私人資助者的代理人，亦與他們沒有關聯。本平台提供的資料及搜尋結果僅為一般資訊，不應被依賴或用作資助決定的依據。

 

  1. User registration

用戶註冊

 

3.1    All Users must register prior to using our Platform.

所有用戶使用本平台前必須註冊。

 

3.2    In order to use our Platform, you must:

為使用本平台， 閣下必須：

 

(a)    provide truthful and accurate personal information, including your name and email address;

(b)    update us promptly if you have any change in your personal information; and

(c)    take appropriate measures to avoid unauthorised use of your account.

 

提供真實及準確的個人資料，包括 閣下的名稱及電郵地址；

如 閣下的個人資料有任何變更，請盡快聯絡我們以作更新；及

採取適當措施避免未經授權使用 閣下的帳戶。

 

3.3    To optimise system performance and stability of our Platform for all users, we impose a fair usage limit on each account. We therefore urge you not to share your account credentials or give others access to your account. If we detect any unauthorised or malicious use of an account, we may suspend or terminate the account.

為提高本平台的系統性能及穩定性，我們對每個帳戶均施加公平使用限制。因此，我們促請 閣下不要與他人共享帳戶或允許他人到訪 閣下的帳戶。如我們偵測任何未經授權或惡意使用帳戶的行為，我們可能暫停或終止有關帳戶。

 

3.4    By using our Platform you agree to follow our Acceptable Use Policy. We reserve our right in suspending or terminating any account that violates the Acceptable Use Policy.

使用本平台即表示 閣下同意遵守我們的可接受使用政策。我們保留暫停或終止任何違反可接受使用政策的帳戶的權利。

 

  1. Usability

使用性

 

4.1    We try our best to ensure that our Platform is available anytime, but we do not guarantee that the operation of or access to our Platform will always be uninterrupted or continuous. Our Platform may be interrupted for maintenance, archiving, repairs, upgrades, or due to network or equipment failures.

我們會盡力確保本平台的可用性，但我們無法保證用戶能無間斷地或連續地到訪或使用本平台。本平台可能因維護、存檔、維修、升級、網絡或設備故障而中斷。

 

4.2    We are constantly changing and improving our Platform and the products or services we provide. We may from time to time change or discontinue any of the products or services we offer, or add or remove functionalities or features, and we may suspend or stop certain products, services, functionalities or features altogether.

我們持續地更正及改善本平台及我們提供的產品或服務。我們可能隨時修改或中止我們提供的任何產品或服務，增加或刪除其功能或特性，以及我們可能暫停或停止部分產品、服務、功能或特性。

 

4.3    You are responsible for configuring your information technology, computer programmes and platform or system in order to access our Platform. We do not guarantee that our Platform will be free from bugs or viruses.

閣下需自行負責配置 閣下的信息技術、電腦程序及平台或系統進入本平台。我們無法保證本平台完全沒載有任何電腦病毒或缺陷。

 

4.4    Our Platform may include links to third-party websites, such as the websites of Funders, Projects or Project Owners. If you access any of these third-party websites, you will be doing so at your own risk. We do not examine or evaluate the information of any third-party websites. We expressly disclaim any liability or responsibility for any material or information contained in any third-party websites, or any products or services offered by third parties.

本平台可能包含第三方網站的連結，如資助者、項目或項目擁有人的網站。閣下到訪任何第三方網站需自行承擔風險。我們不會檢查或評估任何第三方網站的資料。我們明確表示不對任何第三方網站中的任何材料或資料、或任何第三方提供的產品或服務，承擔任何法律責任或其他責任。

 

  1. Limitation on Liabilities

責任限制

 

5.1    To the fullest extent permitted by law, we (including our holding company(ies), subsidiaries, affiliates, directors, officers, employees, contractors, interns and agents from time to time, collectively, “Our Entities”) expressly limit our liabilities in connection with or arising out of the provision of the Platform as follows:

在法律允許的最大範圍內，我們（包括我們不時的控權公司、附屬公司、關聯公司、董事、高級人員、僱員、承包人、實習生及代理人）明確限制我們與本平台相關或由此產生的責任如下：

 

  1. we provide the Platform and any products or services we offer on an “as is” and “as available” basis, and your access to or use of our Platform is at your own risk;

  1. we give no assurance, representation or warranty of any kind (whether express or implied) about the Platform and any products or services we provide;

我們不就本平台及我們提供的任何產品或服務作出任何形式（不論明示或暗示）的保證、陳述或擔保；

 

  1. we do not guarantee that the information or content you find on the Platform is always accurate, truthful, complete and up-to-date;

我們無法保證 閣下在本平台上找到的資料或內容永遠準確、真實、完整及最新；

 

  1. we expressly disclaim all warranties and representations (for example, warranties of merchantability, fitness for a particular purpose, and non-infringement);

我們明確表示不承擔任何保證及陳述（如適銷性、特定目的的適用性及非侵權性等的保證）；

 

  1. we are not responsible for any delay or disruption in our Platform or any defect, viruses, bugs or errors; and

我們不對本平台的任何延遲或中斷，或任何缺陷、電腦病毒或錯誤負責；及

  1. we are not responsible for the conduct of or any content or information submitted or posted by any user of the Platform (whether online or offline).

我們不對本平台的任何用戶（無論在線或離線）提交或發布的任何內容或資料的行為負責。

 

5.2    To the fullest extent permitted by law, Our Entities are not liable to you or others for:

  • any indirect, incidental, special, exemplary, consequential or punitive damages; or

任何間接、附帶引起、特殊、懲戒性、相應而生或懲罰性的損害賠償；或

 

  • any loss of data, business, opportunities, reputation, profits or revenues,

任何數據、業務、機會、聲譽、利潤或收入的損失，

 

relating to the use of our Platform or any products or services we offer.

與使用本平台或我們提供的任何產品或服務有關。

5.3    We do not exclude or limit our liability to you where it would be illegal to do so. Some countries or jurisdictions may not allow the disclaimers in this clause, in which case these disclaimers will not apply to you.

假如法律不許可，我們就不會排除或限制對 閣下的責任。部分國家或司法管轄區不允許本條款中的免責聲明，有關免責聲明將不適用於 閣下。

 

  1. Intellectual property rights

知識產權

 

6.1    All intellectual property rights subsisting in our Platform, including our database and our search tool, our products and services offered from time to time, and all improvements, enhancements, modifications, updates from time to time, belong to us. All rights under applicable laws are hereby reserved.

於本平台所存在的一切知識產權，包括我們的數據庫及搜索工具、我們不時提供的產品及服務，以及所有改善、提升、修訂及更新，均屬於我們所有。由適用法例所授予的一切權利，茲在此予以保留。

 

6.2    Reproducing, publishing, distributing, selling of any parts or components of our Platform is strictly prohibited, unless with our prior express written consent.

嚴禁複製、發布、分發及銷售本平台任何部分或組件，除非事先得到我們明確書面同意。

 

6.1    By registering as a User, you are given a personal, worldwide, royalty-free, non-assignable, non-transferrable, non-exclusive and revocable licence to access and use our Platform. Such licence is for the sole purpose of enabling you to use and enjoy the benefit of our Platform as offered by us and in such manner as permitted by these Terms.

註冊成為用戶後，我們將授予 閣下一個個人、全球性、免版稅、不可轉讓、非獨家及可撤回的許可，以到訪及使用本平台。此許可僅限於 閣下在本條款允許的情況下使用本平台。

 

6.2    Your licence to use our Platform will be revoked and terminated if you breach any of these Terms, including the Acceptable Use Policy.

如 閣下違反任何條款，包括可接受使用政策，閣下的許可將被撤銷及終止。

 

6.4    Our brand name and our marks and logos are our trademarks and may not be used without our express written consent.

我們的品牌名稱及標誌均屬寫字的商標，未經我們明確書面同意不得使用。

 

6.5    We welcome Project Owners to provide updated information concerning any Project. We may at our discretion (but are not obliged to) publish such information, and we reserve our right to edit or modify such information prior to publishing. By providing information to us, the Project Owner grants us a worldwide, royalty-free, non-assignable, non-transferrable, non-exclusive and revocable licence to publish and distribute such information on our Platform. We are not responsible or liable for the use of any such information.

我們歡迎項目擁有人提供有關任何項目的最新消息。我們可酌情（但並非有責任）發布有關資料，並保留於發布前編輯或修訂該資料的權利。向我們提供資料代表該項目擁有人授予我們一個全球性、免版稅、不可轉讓、非獨家及可撤回的許可，以在本平台發布及分發有關資料。我們不對有關資料的使用承擔任何法律責任或其他責任。

 

6.6    In these Terms, “intellectual property rights” include patents, rights to inventions, copyright and related rights, all other rights in the nature of copyright, trade marks, business names and domain names, rights in get-up, goodwill and the right to sue for passing off, rights in designs, database rights, rights to use and protect the confidentiality of confidential information (including know-how), and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.

本條款中，「知識產權」指任何及所有知識產權，包括但不限於下列各項，以及由此產生或與之相關的所有產權（無論其是否已註冊）：(1)專利；(2)專有技術、商業秘密、概念、發明、發現、發展、裝置、方法和程序（上述各項不論是否可獲專利）；(3)商標、服務商標、商號和商品名稱及其任何商譽；(4)任何設計權；(5)版權、軟件、程式源碼、目標代碼、規格及其他著作權作品、數據庫和數據庫權限；(6)與上述所有情況相關的任何其他知識產權及有關文件；(7)上述任何權利的任何註冊或註冊申請，或是註冊或申請註冊的任何權利；(8)世界上任何地方的法律下，任何與上述相似或類似的權利。

 

  1. Acceptable Use Policy

可接受使用政策

 

As part of these Terms, you agree not to misuse the Platform or help anyone else to do so. In particular, you agree not to do any of the following in connection with the Platform:

作為本條款的其中一部分，閣下同意不濫用及不協助他人濫用本平台。閣下同意不就本平台進行以下行為：

  1. use our Platform for any unlawful or unauthorised purposes;

為任何非法或未經授權的目的使用本平台；

 

  1. sell, re-sell or attempt to benefit in a commercial fashion from any data, content or information available on the Platform;

銷售、轉售，或試圖以商業的方式從本平台上任何數據、內容或資料獲利；

 

  1. probe, scan, or test the vulnerability of any system or network;

探測、掃描或測試任何系統或網絡的漏洞；

 

  1. breach or otherwise circumvent any security or authentication measures or service usage limits;

違反或以其他方式逃避任何安全或認證措施或服務使用限制；

 

  1. access, tamper with, or use non-public areas or parts of the Platform;

進入、擅自更改，或使用本平台非公共的領域或部分；

 

  1. interfere with or disrupt any user, host, or network, for example by sending a virus, trojan, worm, logic bomb, or any other material that is malicious or technologically harmful, overloading, flooding, spamming, or mail-bombing any part of the Platform, or by scripting the creation of any content in such manner as to interfere with or create an undue burden on the Platform;

干擾或損害任何用戶、主機或網絡，如傳送病毒、木馬、蠕蟲、計時炸彈，或採取任何惡意或技術上有害、使網站流量超載、發送垃圾郵件，或進行電郵轟炸等攻撃本平台的任何部分，或透過編寫電腦代碼對本平台造成干擾或不當負擔；

 

  1. reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code for the Platform or any related technology that is not open source, or create any derivative works on our Platform;

對本平台進行反向工程（reverse engineering）、反匯編（disassembling）、反編譯（decompiling），或以其他方式試圖獲取本平台的原始碼或任何非開源技術，或創建任何衍生作品；

  1. copy, translate, make adaptations of our Platform or any of its content without authorisation;

在未經准許的情況下複製、翻譯、改編本平台或其任何內容；

 

  1. access, search, or create accounts for the Platform by any means (automated or otherwise) other than our publicly supported interfaces (for example, “scraping” or creating accounts in bulk) or attempt to do so;

在我們公開支援的界面以外，透過或試圖透過任何方式（包括自動化）到訪、搜索或建立平台帳戶（如網絡抓取（scraping）或建立大量帳戶）；

 

  1. send unsolicited communications, promotions or advertisements, or spam;

發送未經請求的通訊、推廣、廣告或垃圾郵件；

  1. take any action that overloads or disrupts the integrity of infrastructure of our Platform or any of our features or functions;

採取任何對本平台基礎結構完整性或性能施加過大負載或破壞性的行為；

 

  1. spoof, phish, pharm, pretext, spider, crawl, or scrape;

欺騙、網絡釣魚、網路蜘蛛、網路爬蟲或抓取等；

 

  1. post, publish, upload, display, distribute, or share materials that are unlawful, inappropriate, profane, pornographic, obscene, indecent, libelous, defamatory, abusive, or fraudulent;

張貼、發布、上載、展示、分發、或分享任何非法、不當、褻瀆、色情、淫褻、不雅、誹謗、中傷、辱罵、或欺詐的內容；

 

  1. violate the letter or spirit of our terms of use;

違反本使用條款的規定及精神；

 

  1. violate applicable laws or regulations in any way; or

違反適用的法律及法規；或

 

  1. violate or infringe upon our intellectual property rights or the intellectual property rights of others.

違反或侵犯我們或他人的知識產權。

 

  1. Termination

終止

 

8.1    These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Platform, or when you cease using our Platform.

本條款在 閣下或我們終止前一直生效。如 閣下不再希望使用使用本平台，可隨時通知我們終止本條款。如 閣下停止使用本平台，本條款亦將終止。

 

8.2    We reserve the right to suspend or terminate your access to our Platform (or to certain parts or functionalities of our Platform), if we reasonably believe:

我們保留暫停或終止 閣下到訪本平台（或到訪本平台某些部分或功能）的權利，如我們有理由相信：

 

  1. you are in serious or repeated breach of these Terms;

閣下嚴重或屢次違反本條款；

 

  1. you are using the Platform in a manner that would case a real risk of harm or loss to us, other users, or the public;

閣下使用本平台的方式為我們、其他用戶或公眾帶來傷害或損失的真實風險；

 

  1. we are requested to do so by government or regulatory authorities or as required under applicable laws, regulations or legal processes; or

我們應政府或監管機構的要求，或根據適用法律、法規或法律程序的要求；或

 

  1. our provision of the Platform to you is no longer possible or viable.

我們不再可能或可行向 閣下提供本平台。

 

In any of the above cases, we will notify you by the email address associated with your account or at the next time you attempt to access your account, unless we are prohibited from notifying you by law.

在上述任何一種情況下，我們將透過 閣下帳戶登記的電郵地址，或於 閣下下次嘗試登入帳戶時通知 閣下，除非法律禁止我們通知 閣下。

8.3    Upon termination of your access, these Terms will also terminate except for Clauses 5 (Limitation on liabilities) to 10 (Governing law). Termination does not affect any accrued rights or remedies available to you or us.

終止閣下的到訪後，本條款亦將終止，第5條（責任限制）至第10條（管轄法律）除外。終止不影響 閣下或我們已累計或獲得的任何權利或補償。

 

8.4    Where we consider necessary or appropriate, we will report any breach of these terms (or the Acceptable Use Policy) to law enforcement authorities and we will cooperate with such authorities by disclosing your identity and providing any information about you within our systems to them.

在我們認為必要或適當的情況下，我們將向執法機關報告違反本條款（或可接受使用政策）的行為，並與有關機關合作，披露 閣下的身份及提供我們系統內有關 閣下的資料。

 

  1. Other terms

其他條款

 

9.1    Entire agreement: These Terms constitute the entire agreement between any user and us in relation to the use of the Platform. These Terms supersede and extinguish all other agreements, promises, assurances, warranties, representations and understandings between any user and us, whether written or oral, in relation to the use of the Platform.

完整協議：本條款構成我們與 閣下關於本平台及相關服務的完整協議，並取代及消除任何此前雙方之間所有就本平台及相關服務的書面或口頭協議、承諾、保證、擔保、陳述及理解。

 

9.2    Transfer: As a registered User, you may not transfer your account to any third party, nor any of your rights or obligations under these Terms. As the owner, developer and operator of our Platform, we may transfer our rights and obligations under these Terms to another organisation. We will notify you as soon as practicable if we plan to do this.

轉讓：閣下只能自行使用本平台，帳戶不得轉讓予他人， 閣下作為用戶的權利及責任亦不得轉讓予他人。作為本平台的擁有者及開發商，我們可能將本平台及本條款下我們的權利及責任轉讓予第三方。如發生此等轉讓，我們將在切實可行範圍內盡快通知 閣下。

 

9.3    Variations: We may modify these Terms from time to time as we update or upgrade our Platform, our products or our services. If we make material changes, we will notify you of the changes before they become effective. By continuing to use our Platform after the changes come into effect means that you agree to be bound by the Terms as modified.

條款更新：我們可能不時修訂本條款，以更新本平台及相關服務或產品。如我們作出重大變更，我們將在該變更生效前通知 閣下。於變更生效後繼續使用本平台，代表 閣下同意受修訂後的條款約束。

 

9.3    Severability: If any provision of these Terms becomes invalid or unenforceable, it will be deemed modified (to the minimum extent necessary) to make it valid and enforceable, or where such modification is not possible, deemed deleted and will not affect the validity and enforceability of the remaining provisions.

可分割性：如本條款中的任何條文被宣布為無效或無法執行，該條文將被視為作出（在必要最低限度內）修訂，使其有效及可執行；如該修訂不可能，該條文則被視作刪除，並不影響其餘條款的有效性及可執行性。

 

9.5    Language: In case of discrepancies between the English and Chinese language versions of these Terms, the English version shall prevail.

  1. Governing law

 

These terms are governed by and shall be construed in accordance with the laws of the Hong Kong Special Administrative Region.
